1. Introduction & The Platform
MONAAN (the "Platform") is operated by MONAAN Pty Ltd. These Terms of Service ("Terms") govern your access to and use of the Platform, including any bookings, payments, and communications made through the system.
Platform Facilitation: MONAAN acts as a technology platform that facilitates bookings between Clients and Merchant Partners (Shop Owners). When you book a service, you are entering into a direct contract with the Merchant Partner. MONAAN is not a provider of grooming, beauty, or wellness services.
2. Australian Consumer Law (ACL)
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to:
- Cancel your service contract with us; and
- A refund for the unused portion, or to compensation for its reduced value.
Merchant Partners are solely responsible for the delivery of grooming services in accordance with ACL standards of "due care and skill."
3. Bookings & "Walk-Out" Payments
Upfront Payment: To secure a "Priority Access" booking, the Platform may process a payment or pre-authorization at the time of booking.
GST: All prices listed on the Platform are in Australian Dollars (AUD) and are inclusive of 10% Goods and Services Tax (GST) unless otherwise stated.
The Walk-Out Experience: By using MONAAN, you authorize the Platform to settle the final service price automatically upon completion of the session. This allows you to bypass the front desk and leave the venue immediately after your service.
4. Cancellations & No-Show Fees
Our Merchant Partners operate on high-precision schedules. Late cancellations or no-shows cause direct financial loss to our professionals.
Strict 5-Minute Late Policy: To guarantee zero wait times for all clients, the Platform enforces a strict punctuality standard. If you arrive more than 5 minutes late to your appointment, you may be considered a "no-show". In such cases, the Merchant Partner reserves the right to forfeit your booking and retain the prepaid amount as a penalty.
Liquidated Damages: Cancellation fees are not "penalties." They are a genuine pre-estimate of the loss suffered by the Merchant Partner for a lost time-slot. Fees vary by Merchant and are clearly displayed during the booking flow. By confirming a booking, you agree to these specific terms.
5. User Conduct & Privacy
You agree to provide accurate information and maintain the security of your account. MONAAN handles your data in accordance with our Privacy Policy and the Privacy Act 1988 (Cth).
6. Limitation of Liability
To the maximum extent permitted by law (and subject to your rights under the ACL), MONAAN's liability for any claim related to the Platform is limited to the total service fees paid by you to MONAAN in the 6 months preceding the claim.
7. Governing Law
These Terms are governed by the laws of New South Wales, Australia. You and MONAAN submit to the non-exclusive jurisdiction of the courts of that State.
